Deportation & Removal
Individuals who end up in the deportation system because they have committed a crime or were caught as an illegal alien need aggressive and knowledgeable representation. Your rights and your ability to stay in this country legally are at stake. At the Law Office of David Estrella P.A., we will educate you about the issues and represent you throughout the process.
If you have been arrested for a misdemeanor or felony crime and offered a plea bargain, contact the Law Office of David Estrella P.A. immediately before accepting it. A plea will not make the matter go away. The consequences of taking the plea could result in immediate removal proceedings being instituted against you.
We can assist you in navigating through the complex removal system whether you have been detained over an alleged crime or you were discovered as an illegal alien. An experienced lawyer can explain the deportation and immigration consequences no matter how minor or serious your situation may be. A crime resulting in removal is usually more severe than the criminal consequences.
If you are eligible to stay in this country, we will do everything possible to help you accomplish that goal. Eligibility is based upon having dependents (your spouse and children) and other family members who are already U.S. citizens or permanent residents. Our job will be to try to keep you in the country and united with your family through the immigration court system.
Further, the US government in recent years has shown new flexibility in its enforcement of the immigration laws, providing two new options for those immigrants who find themseles in the unfortunate situation of fighting deportation/removal. These options are Deferred Action for Childhood Arrivals (DACA) and Prosecutorial Discretion (PD). DACA helps those who came to the United States before June 15, 2007 and who entered the United States prior to their 16th birthday and who were under 31 years of age on June 15, 2012. PD helps those immigrants who are in removal proceeds to avoid removal/deportation based upon several factors including a history of good moral character, ties to the United States, etc.
